SMS and Email Policy
Uevar Inc. Effective Date: May 13, 2026 Last Updated: May 13, 2026 Applies to: TCPA (SMS), CAN-SPAM (Email), and California Business & Professions Code §17529 et seq.
1. Purpose
This policy describes how Uevar Inc. sends text messages (SMS) and emails to users, and how you can control the messages you receive. It reflects Uevar's commitments under the Telephone Consumer Protection Act ("TCPA"), the CAN-SPAM Act, and applicable state laws including California's anti-spam statute.
2. SMS — Opt-In and Consent
2.1 Opt-In Consent
We only send marketing or recurring text messages to users who have affirmatively opted in. At every SMS opt-in point, we display the following disclosure:
"By checking this box you agree to receive recurring automated marketing text messages from Uevar at the number provided. Consent is not a condition of any purchase. Msg & data rates may apply. Reply STOP to cancel, HELP for help."
- Opt-in checkboxes default to unchecked.
- Consent is affirmative and unambiguous — a pre-checked box or required field does not count.
- Transactional SMS (account verification, password reset, security alerts) does not require marketing consent but we still respect STOP requests.
2.2 Marketing vs. Transactional SMS
- Marketing SMS (promotional content, points updates, referral nudges, feature announcements): Sent only to users who have opted in to marketing SMS.
- Transactional SMS (one-time passwords, security codes, critical service alerts): Sent only for the specific transactional purpose triggered by your action.
2.3 Suppression
Before we send any SMS, we check our internal suppression records. If you have unsubscribed, we will not send the message. For marketing SMS, we also confirm your current opt-in is on file.
2.4 STOP, HELP, and UNSTOP
You can manage your SMS subscription at any time using the following keywords:

STOP requests are honored immediately.
2.5 Frequency
For recurring message programs, the opt-in confirmation message includes a frequency disclosure (e.g., "Message frequency varies").
3. Email — Opt-In and CAN-SPAM
3.1 Marketing vs. Transactional Email
- Transactional email (account verification, password reset, security notifications, direct responses to user actions): Sent without marketing consent but always includes an unsubscribe option for marketing email.
- Marketing email (newsletters, feature announcements, promotional offers, Points updates): Sent only to users who have opted in to marketing email.
Marketing email opt-ins are kept separate from SMS opt-ins and from account creation terms acceptance. Pre-checked marketing email boxes are not used.
3.2 Suppression
Before we send any commercial or marketing email, we check our internal suppression records. If you have unsubscribed, we will not send the message. For marketing emails, we also confirm your current marketing opt-in is on file.
3.3 Required Elements in Every Commercial Email (CAN-SPAM)
Every commercial email sent by Uevar includes:
- Accurate "From" name clearly identifying Uevar Inc. as the sender.
- Accurate, non-deceptive subject line.
- Physical postal address: Uevar Inc., 447 Broadway, 2nd Floor Suite #3453, New York, NY 10013, United States.
- Clear unsubscribe mechanism: A one-click unsubscribe link (or a simple reply-to mechanism) that works for at least 30 days after the email is sent.
- Prompt unsubscribe processing: Unsubscribe requests are honored within 10 business days. Unsubscribe is not conditioned on providing information beyond an email address.
- Truthful sender identification. If a third party delivers email on Uevar's behalf, Uevar and that third party are jointly responsible for CAN-SPAM compliance.
3.4 Transactional Email Footer
Even transactional emails include a brief footer explaining how to opt out of marketing emails, for example:
"This is a service message from Uevar. To stop receiving marketing emails, [unsubscribe here]."
4. No Purchased Lists
Uevar does not purchase, rent, or borrow email or phone number lists from third parties. We only send communications to individuals who have:
- Directly provided their email or phone number to Uevar; and
- Either provided affirmative marketing consent or are recipients of a transactional communication triggered by their own action.
5. No Auto-Send to Referred Contacts
When a user refers a contact to Uevar, Uevar may send a one-time notification to the referred contact only if the referral mechanism collects and records that contact's consent before or at the time of sending. The referring user's act of sharing a referral link does not constitute consent on behalf of the referred contact.
6. Consent Records
For every SMS or email opt-in, Uevar records and retains a consent record that includes the user identifier, the consent timestamp (UTC), the IP address from which consent was provided, the version of the consent screen displayed, the type of consent (e.g., marketing SMS, marketing email), and the opt-in text presented.
Consent records are retained for at least 5 years from the date of consent or the date of the last message sent under that consent, whichever is later.
7. Sender Identification
All outbound SMS messages include the sender name "Uevar" or a clear short code or long code registered to Uevar. All outbound emails are sent from a sender domain or subdomain controlled by Uevar (e.g., @uevar.com). SPF, DKIM, and DMARC are configured for our email sending domains.
